The present document describes the terms and conditions of use of the www.emergencyresponse.eu web site (hereinafter referred to as the “Safer Web Site”) by any user (hereinafter referred as to the “User”).
Please read carefully the terms and conditions contained herein.

The following terms and conditions are not applicable to the use of the Project Area of the Safer Web Site by the Safer Consortium Agreement Signatories. The Project Area of the Safer Web Site access is restricted and reserved to the Safer Consortium Agreement signatories.

Acceptance

By accessing and using the Safer Web Site, any user and the Safer Consortium agree to be bound by the terms and conditions set forth below:

The Safer Web Site (excluding linked sites) is controlled by the Safer Consortium, represented according to the Safer Consortium Agreement ref. ITF-AJ-0107-08 signed by and between the Safer Consortium partners (hereinafter referred to as the “Safer Consortium Agreement”),by its coordinator, INFOTERRA France, a Société par Actions Simplifiée registered under laws of France, located at 31 rue des Cosmonautes, 31402, Toulouse. All matters concerning the access to or use of the Safer Web Site shall be governed by the laws of France. Those who choose to access the Safer Web Site from other locations do so on their own behalf and are responsible for compliance with local laws.

If the User doesn't agree to the terms of this document the User is not authorized to use any information included on the Safer Web site.

Ownership

The User hereby agrees that according to the Safer Consortium Agreement, Safer Consortium and/or its partners shall have the sole and exclusive title to and ownership of all products -and any other right acquired by the Safer Consortium from the owners-, which are used on the Safer Web site and all copyright, trade secret, patents and other intellectual property rights therein and in any graphic or other representation thereof.

All Safer Consortium intellectual property rights with the design use or production of any part of the Safer Web Site are and remain the sole and entire property of the Safer Consortium according to the Safer Consortium Agreement and its providers.

Copyright

Any data included in the Safer Web Site is copyrighted by the Safer Consortium and/or its third party providers and copying of the said data is expressly prohibited except as indicated below in Right of Use.

Trade name and trade marks

The trade marks, services marks and logos displayed on the Safer Web Site are the property of the Safer Consortium.

Confidentiality

The User acknowledge that he may obtain direct access to confidential or protected information via the Safer Web Site relating to databases belonging to the Safer Consortium and its providers such as technical, marketing and other valuable information. The User must hold information in strict confidence. The User may use it solely for the purpose of contacting the Safer Consortium either as an individual or on behalf of its employer.

Any breach of this commitment shall result in irreparable harm to the Safer Consortium for which damages would be inadequate remedy and in addition to its rights and remedies available at law; the Safer Consortium shall be entitled to equitable relief if such breach occurs.

 Right of use

The User agrees not to change or delete any proprietary notices from materials downloaded from the Safer Web Site.

All rights to reproduction are reserved; including those for the documents available for download and the iconographical and photographic representations (all rights not expressly conceded are reserved).

The products and documentation made available to download from the Safer Web Site are strictly limited to the following conditions:

The User may make copies of any portion of material downloaded from different items of the area of the Safer Web Site for informational and non-commercial purposes.

The User agrees not to modify, decompose, adapt, translate, and create derivative works based on products and/or services contained in the Safer Web Site in whole or in part for any other purposes than informational purpose. Any copying, re-distribution, re-transmission or publication of any downloaded material for any other purposes than informational purpose is strictly prohibited without the prior written consent of the Safer Consortium or any third party information provider to the Safer Web Site.
Nothing on the Safer Web Site shall be construed as conferring any license under any of Safer Consortium's or any third party provider's intellectual property rights whatever. The User acknowledges its responsibility for obtaining such licenses.

Links

This Safer Web Site contains links to other third party web sites. The linked Sites are not controlled by The Safer Consortium. The Safer consortium is not responsible for the contents of any linked site and for any transmission from the said site. THE SAFER CONSORTIUM IS PROVIDING THESE LINKS MERELY AS A CONVENIENCE AND THE INCLUSION OF ANY LINKED SITE IS NOT AN ENDORSEMENT BY THE SAFER CONSORTIUM.

Warranties and Liabilities

The Safer Consortium doesn't warrant that the materials on the Safer Web Site are available for use in other locations than France and accessing from any territories.

Except as expressly provided in an agreement between the User and the Safer Consortium, all materials, information, documentation on the Safer Web Site are provided on an "AS IS" basis, without any other warranties or representations or endorsement express or implied and the Safer Consortium expressly disclaims and the User expressly waives any and all warranties, express or implied, arising by law, custom or usage of trade or otherwise, including but not limited to the fitness for a particular purposes with regard to any merchandise, information, documentation provided through the Safer Web Site or on the Internet, generally.

THE SAFER CONSORTIUM SHALL NOT BE LIABLE FOR ANY COST OR DAMAGE ARISING EITHER DIRECTLY OR INDIRECTLY FROM ANY USE OF THE SAFER WEB SITE. IT IS THE USER RESPONSIBILITY TO EVALUATE THE ACCURACY, COMPLETENESS AND USEFULNESS OF MERCHANDISE AND OTHER INFORMATION PROVIDED THROUGH THE SAFER WEB SITE OR ON THE INTERNET GENERALLY.

IN NO EVENT SHALL THE SAFER CONSORTIUM BE LIABLE FOR(i) ANY DIRECT PREJUDICE AND/OR INDIRECT PREJUDICE AND INCIDENTAL CONSEQUENTIAL OR ANY DAMAGES (INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF PROGRAMS OR INFORMATION AND THE LIKE)ARISING OUT OF THE USE OF OR INABILITY TO USE ANY OF THE INFORMATION ON THE Safer WEB SITE OR DOWNLOADED OR HYPERLINKED FROM THE SAFER WEB SITE, EVEN IF THE SAFER CONSORTIUM OR ITS AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR(ii) ANY CLAIM RESULTING FROM ERRORS, OMISSIONS OR OTHER INACCURACIES IN THE SAFER WEB SITE AND/OR MATERIALS OR INFORMATION DOWNLOADED THROUGH OR FROM THE SAFER WEB SITE, TO THE GREATEST EXTEND PERMITTED BY LAW.
